This Data Subject Access Request (DSAR) Procedure outlines how knowyourWorkergh.com ("the Company") receives, processes, and responds to requests from individuals ("Data Subjects") regarding their personal data, in compliance with the Data Protection Act, 2012 (Act 843) of Ghana.
2. Scope
This procedure applies to:
- All personal data processed by knowyourWorkergh.com
- All employees, contractors, and authorized third parties handling personal data
- Requests made by workers, clients, users, or other individuals whose data we process
3. What Is a DSAR?
A DSAR is a formal request made by a data subject to:
- Access their personal data
- Request correction or updating of inaccurate data
- Request deletion of personal data (where legally permissible)
- Object to or restrict processing
- Withdraw consent (where processing is consent-based)
4. How to Submit a DSAR
Data subjects may submit a DSAR through any of the following channels:
Requests should include:
- Full name of the data subject
- Contact details (email and/or phone number)
- Description of the request
- Proof of identity (to prevent unauthorized disclosure)
5. Identity Verification
Before processing a DSAR, knowyourWorkergh.com will:
- Verify the identity of the requester using reasonable means
- Request additional identification if necessary
No data will be disclosed until identity verification is complete.
6. DSAR Processing Steps
Acknowledgement
Acknowledge receipt of the request within 7 working days.
Assessment
Determine the scope and validity of the request. Identify relevant data systems and records.
Data Collection
Retrieve applicable personal data from databases, records, and third parties.
Review and Redaction
Review data to ensure it does not infringe on the rights of others. Redact third-party or legally protected information.
Response
Provide a response within 21 days of receiving a valid request, as required under Act 843.
7. Response Format
Responses will be provided:
- In writing, electronically or physically
- In clear, understandable language
- At no cost, unless the request is excessive or repetitive
8. Grounds for Refusal or Limitation
A DSAR may be refused or limited where:
- Disclosure would reveal personal data of another individual
- The request is manifestly unfounded or excessive
- The data is required for legal proceedings or law enforcement
- Retention is required by law or regulatory obligation
Any refusal will be communicated with reasons provided.
9. Data Correction and Deletion
- Inaccurate or incomplete data will be corrected upon verification
- Deletion requests will be honored where no legal or contractual obligation requires retention
10. Record-Keeping
The Company shall maintain a DSAR log containing:
- Date of request
- Nature of request
- Identity verification method
- Action taken
- Date of response
Records will be retained for audit and compliance purposes.
11. Third-Party Processors
Where personal data is processed by third parties:
- knowyourWorkergh.com will coordinate with processors to fulfill DSAR obligations
- Processors are contractually required to assist in compliance
12. Staff Responsibilities
- All staff must immediately forward DSARs to the designated Data Protection Officer (DPO) or responsible officer
- Failure to comply with this procedure may result in disciplinary action
13. Complaints and Escalation
If a data subject is dissatisfied with the response, they may:
- Request internal review
- Lodge a complaint with the Data Protection Commission of Ghana
